Beach Boys Member Hit With Infringement Suit

Brother Records, the company that holds the trademark to the Beach Boys, has filed suit against band member Al Jardine to prevent him from continuing the "Beach Boys Family and Friends Tour."

Court papers filed with the U.S. District Court in Los Angeles charge that Jardine's act isn't living up to the band's image of ''cars, surf, girls and fun,'' the Los Angeles Times reports. A Dec. 13 injunction hearing has been set to decide if Jardine can continue to use the Beach Boys' name.

Both Jardine and bandmate Mike Love have been using the Beach Boys' name, but only Love's act has been licensed by Brother Records. The suit says that Jardine's act detracts from the image of the Beach Boys' four-part harmonies.

In Florida this year, according to the lawsuit, 1,700 angry fans who thought they were attending a Beach Boys show demanded refunds following a concert by Jardine's band, which features three female singers.

Jardine and Love have been feuding since the death of bandmate Carl Wilson last year, the lawsuit says.
